For the Personal Data of EU and Swiss residents, we comply with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively (collectively, the “Privacy Shield”). We have certified to the Department of Commerce that we adhere to the Privacy Shield Principles regarding EU and Swiss Personal Data received under the Privacy Shield. If there is any conflict between the terms in this Notice and the Privacy Shield Principles, the Privacy Shield Principles shall govern in matters regarding EU and Swiss residents. We collect information through technology to enhance our ability to serve you. In addition, we gather certain usage information like the numbers and frequency of visitors to our websites, activity levels, most used browsers, and other useful statistics similar to the television ratings which tell how many people tuned into a program.

Do we use cookies on our Websites?
Yes. Cookies are small text files that a site or its service provider transfers to your computer’s hard drive through your web browser that enables the Website to recognize your browser and capture and remember certain information. Your ‘Do Not Track’ Browser Setting
Do Not Track (“DNT”) is a preference you can set in your browser’s settings to let the websites you visit know that you do not want the websites collecting your personal information. Our Site does not currently respond to DNT browser settings across all pages and features of the Site. Children’s Online Privacy Protection Act Compliance

We do not collect any information from anyone under 13 years of age. Our web sites, products, and services are all directed to people who are over the age of 13. If you are under the age of 13, you are not authorized to use this Site.

Ownership of Information and Materials You Voluntarily Submit to Us Via the Site

Except as otherwise provided in any Terms and Conditions applicable to saddle Creek, we are the sole owners of any information that you submit through the Site, and any photos, documents, works of authorship, or other items (“Contributed Materials”) that you voluntarily provide to us through the Site. We are not obliged to return any Contributed Materials to the person contributing them. EEA Personal Data

We may collect, use and disclose certain personally identifiable information that we receive in the US from the European Economic Area (“EEA Personal Data”). Saddle Creek recognizes that the EEA has established strict protections regarding the handling of EEA Personal Data, including requirements to provide adequate protection for EEA Personal Data transferred outside of the EEA pursuant to the European Union’s General Data Protection Regulations (“GDPR”).

Specifically with respect to EEA Personal Data, we may transfer EEA Personal Data to our third-party agents or service providers who perform functions on our behalf. Where required by the Privacy Shield, we enter into written agreements with those third-party agents and service providers requiring them to provide the same level of protection GDPR requires and limiting their use of the data to the specified services provided on our behalf. We take reasonable and appropriate steps to ensure that third-party agents and service providers process EEA Personal Data in accordance with our Privacy Policy obligations and to stop and remediate any unauthorized processing. Under certain circumstances, we may remain liable for the acts of our third-party agents or service providers who perform services on our behalf for their handling of EEA Personal Data that we transfer to them.

Saddle Creek maintains reasonable and appropriate security measures to protect EEA Personal Data from loss, misuse, unauthorized access, disclosure, alteration, or destruction in accordance with GDPR. You may have the right to access the EEA Personal Data that we hold about you and to request that we correct, amend, or delete it if it is inaccurate or processed in violation of GDPR. These access rights may not apply in some cases, including where providing access is unreasonably burdensome or expensive under the circumstances or where it would violate the rights of someone other than the individual requesting access. If you would like to request access to, correction, amendment, or deletion or limit our use and/or disclosure of your EEA Personal Data, you can submit a written request to the contact information provided herein. We may request specific information from you to confirm your identity. In some circumstances we may charge a reasonable fee for access to your information.

Complaints or disputes about how we handle EU or Swiss Personal Data should be directed to the below address. We will promptly investigate and try to resolve any such complaints or disputes internally. But, if we can’t reach a mutually agreeable resolution, we have agreed to cooperate with the dispute resolution procedures administered by, as applicable, the European Data Protection Authorities or the Swiss Federal Data Protection and Information Commissioner. Under certain conditions, by notifying us, you may invoke binding arbitration regarding certain “residual” claims about EU or Swiss Personal Data before a Privacy Shield Panel. Such procedure is in accordance with the rules established under the Privacy Shield.  We are subject to the investigatory and enforcement powers of the FTC for EU and Swiss Personal Data.

If we change this Privacy Policy, we will post those changes on this page and update the “Last Updated” date above, which shall constitute the effective date of any changes we made to the Privacy Policy.
